Welcome to Hyperzoned (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your use of the Hyperzoned website, application, and services (collectively, the “Service”). By signing up for Hyperzoned, you agree to these Terms.

1. Eligibility

• You must be 18 years or older to create a paid account and purchase a subscription.
• If you are 13–18 years old, you may only use Hyperzoned with the consent and supervision of a parent or guardian.
• By signing up, you confirm that all information you provide is accurate and that you have the right to use the payment method provided.

2. Subscriptions, Free Trial & Billing

• Subscription Required: Hyperzoned is a subscription-only service.
• 14-Days Free Trial: When you sign up, you receive a 14-days free trial. After this period, your paid subscription will automatically begin unless you cancel before the trial ends.
• Payment Processing:
  • Payments are handled by Paddle, our Merchant of Record.
  • Paddle processes your payment securely, handles tax compliance (VAT/GST), and issues invoices.
  • By subscribing, you also agree to Paddle’s Terms & Privacy Policy.
• Auto-Renewal: Subscriptions renew automatically unless you cancel before the renewal date.
• Price Changes: We may adjust subscription prices in the future, with reasonable prior notice. New pricing will take effect on your next billing cycle.
• Refunds: Refunds are handled clearly, subject to Paddle’s refund policies and applicable laws. See our refund policy for more details.

3. Account Responsibilities

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity under your account.
• Notify us immediately if you suspect unauthorized use of your account.

4. Use of the Service

By using Hyperzoned, you agree NOT to:

• Violate any laws or regulations while using the Service.
• Attempt to bypass subscription or payment systems.
• Upload harmful, illegal, or infringing content.
• Disrupt or exploit the Service in ways that could harm other users or the platform.

5. AI Features

• Hyperzoned offers optional AI-powered features (e.g., task suggestions) powered by third-party AI services like OpenAI’s ChatGPT and Anthropic’s Claude.
• What we send: Only task and project details you provide are sent to these AI services for processing.
• What we do NOT send: Your personal information (e.g., email, profile picture, payment details) is never shared with AI providers.
• Disclaimer: AI outputs may not always be accurate or appropriate. You are responsible for reviewing and deciding how to use AI suggestions.

6. Data & Storage

• All core data is hosted on Hetzner servers (EU-based).
• Certain files (like profile pictures) are stored in Cloudflare D2 object storage.
• Cloudflare also provides performance optimization (CDN) and security protection for Hyperzoned.

7. Termination

• You may cancel your subscription or delete your account at any time in your account settings.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Service.

8. Limitation of Liability

• Hyperzoned is provided “AS IS” and “AS AVAILABLE.”
• We are not liable for:
  • Temporary service interruptions or data loss.
  • Indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid in subscription fees in the 12 months prior to the issue.

9. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we’ll notify you via email or in-app.

Continued use of Hyperzoned after changes means you accept the updated Terms.

10. Governing Law

• These Terms are governed by the laws of India.
• Any disputes will be handled in the courts of India, unless otherwise required by law.
